1. Agreement to Terms

By accessing and using the Tempero Creative website (tempero.nz) and engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

2. Our Services

Tempero Creative provides professional creative services including but not limited to videography, photography, graphic design, animation, web development, music production, tutoring, event planning, and creative consultation. The specific scope, deliverables, and timeline for any project will be agreed upon between Tempero Creative and the client prior to commencement of work.

3. Enquiries & Consultations

All initial discussions and our first meeting are free of charge. There is no obligation to proceed with any service after an initial consultation. Formal engagement begins only when both parties have agreed on the scope and pricing of a project.

4. Pricing & Payment

• Pricing for our services varies depending on the scope, complexity, and duration of the project.
• A quote or proposal will be provided before any paid work commences.
• We offer one-off pricing, multi-project discounts, and retainer arrangements. A rate card for our most common services is available upon request.
• Tempero Creative is GST registered. All quoted prices are in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise stated.
• Payment terms will be outlined in your project agreement. Late payments may incur additional fees.

5. Project Changes & Cancellations

• Changes to the agreed scope of work may affect pricing and timelines. We will communicate any adjustments before proceeding.
• If you need to cancel a project after work has commenced, you will be responsible for payment of any work completed up to the date of cancellation.
• We reserve the right to cancel or decline a project at our discretion, in which case any pre-paid amounts for undelivered work will be refunded.

6. Intellectual Property

• Client Content: You retain ownership of any content, materials, or intellectual property you provide to us for use in a project.
• Our Work: Upon full payment, you will receive a licence to use the delivered creative works for the purposes agreed upon. Unless otherwise stated in writing, Tempero Creative retains the underlying copyright to all creative works produced.
• Portfolio Use: We reserve the right to display completed works in our portfolio, website, and social media for promotional purposes, unless a confidentiality agreement is in place.

7. Client Responsibilities

To ensure the successful delivery of our services, clients are expected to:

• Provide timely feedback, approvals, and any required materials
• Ensure that any content or materials provided do not infringe on third-party intellectual property rights
• Communicate any specific requirements, restrictions, or concerns at the outset of the project

8. Limitation of Liability

Tempero Creative will endeavour to deliver high-quality creative services in accordance with the agreed scope. However, we do not guarantee specific outcomes or results from the use of our deliverables (e.g., increased sales, social media engagement). Our total liability for any claim arising from our services is limited to the amount paid for the specific service in question.
